Acceptance of Terms

By accessing this website and/or engaging the services of Ideal Painting Limited, you acknowledge that you have read, understood and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, please do not use this website or engage our services.

Services

Ideal Painting Limited provides residential and commercial painting and decorating services throughout New Zealand including but not limited to:

• Residential interior and exterior painting
• Commercial painting and maintenance
• Roof painting and restoration
• Plastering and surface preparation
• Timber staining and protective coatings
• Water blasting and surface cleaning
• Wallpaper removal and specialty finishes
• Colour consultation services

All work is subject to written quotations, scope documents and project agreements. The exact scope, materials, preparation requirements and project timelines will be outlined before work commences. Any services not specifically included within a written quotation shall be considered excluded.

Quotes & Pricing

All quotations remain valid for thirty (30) days unless otherwise stated in writing. Quotes are prepared using information available at the time of assessment and may be revised if:

• Site conditions differ materially from those disclosed
• Existing damage or defects are discovered
• Additional preparation becomes necessary
• Hazardous materials are identified
• Client-requested variations arise

Quoted pricing assumes reasonable site access and uninterrupted work conditions.

Deposits & Payment Terms

Ideal Painting Limited reserves the right to require a deposit prior to commencement. Unless otherwise agreed in writing:

• Deposit required prior to commencement
• Progress payments may apply for larger projects
• Final payment due immediately upon completion

Invoices are payable within the timeframe stated on the invoice. We accept:

• Bank transfer
• Credit card
• Other agreed payment methods

Late payments may incur:

• Interest at 15% per annum calculated daily
• Debt collection costs
• Legal costs incurred recovering unpaid amounts

The Client agrees to indemnify Ideal Painting Limited for all reasonable costs associated with collection of overdue amounts.

Variations

Any request to alter the agreed scope of work after acceptance of a quotation constitutes a variation. Variations may affect:

• Project cost
• Completion timelines
• Materials used
• Labour requirements

Variations may be charged at additional cost and must be approved by the client.

Client Responsibilities

Clients agree to:

• Provide safe and unobstructed site access
• Remove or secure valuable items where required
• Ensure access to power and water where necessary
• Disclose known structural issues, moisture problems or hazardous materials
• Obtain any required landlord or body corporate approvals

Ideal Painting Limited shall not be responsible for delays caused by failure to meet these obligations.

Delays & Force Majeure

Project timelines are estimates only. Ideal Painting Limited shall not be liable for delays caused by circumstances beyond our reasonable control including:

• Severe weather
• Supply chain shortages
• Material availability
• Acts of God
• Government restrictions
• Labour shortages
• Site access restrictions
• Events outside our reasonable control

Where delays occur we will make reasonable efforts to reschedule works promptly.

Hazardous Materials

Unless expressly agreed otherwise, quotations exclude treatment or removal of hazardous materials including:

• Asbestos
• Lead-based paints
• Toxic mould
• Hazardous substances

Should hazardous materials be identified during works, Ideal Painting Limited reserves the right to pause works until appropriate remediation is undertaken. Any resulting delays or additional costs shall be the responsibility of the client.

Workmanship Warranty

Ideal Painting Limited stands behind the quality of its workmanship. Subject to proper maintenance and normal use:

• Interior workmanship warranty: 12 months
• Exterior workmanship warranty: 24 months
• Manufacturer warranties apply to products and coatings used

This warranty does not cover:

• Normal wear and tear
• Structural movement
• Moisture damage
• Building defects
• Cracking due to settlement
• Damage caused by third parties
• Poor maintenance
• Extreme weather events

Any warranty claim must be submitted in writing within the applicable warranty period.

Cancellations & Rescheduling

Cancellation requests must be provided in writing. Cancellation terms:

• More than 7 business days before commencement: full deposit refund
• 4–7 business days: 50% deposit refund
• Less than 3 business days: deposit non-refundable

Where materials have been purchased or labour allocated, additional costs may apply. Reasonable requests to reschedule will be accommodated where possible.

Intellectual Property

All website content including text, graphics, branding, logos and materials displayed on this website remain the property of Ideal Painting Limited unless otherwise stated. No content may be reproduced without written permission.

Website Use

You agree not to:

• Use this website unlawfully
• Attempt to interfere with website security
• Submit malicious content
• Copy website content without permission

We reserve the right to restrict access to our website at our discretion.

Limitation of Liability

To the fullest extent permitted by New Zealand law, Ideal Painting Limited's total liability arising from any claim relating to services provided shall not exceed the value of the services supplied. Ideal Painting Limited shall not be liable for:

• Indirect losses
• Consequential damages
• Loss of profits
• Business interruption
• Delays outside our control

Nothing in these terms excludes rights provided under the New Zealand consumer protection legislation including the Consumer Guarantees Act 1993 where applicable.

Insurance

Ideal Painting Limited maintains appropriate insurance coverage including public liability insurance. Proof of insurance can be provided upon request.

Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of New Zealand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
